…no? Why would the judge care if you were old when you were driving drunk?
If you were charged based on sobriety tests and the arresting officer only cited your inability to walk and balance and there was no blood or breath analysis, you would have a solid chance with a competent lawyer.
And if officer shows up explain you didn’t have gray hair or a cane or mention needing one during the balance test?
Depends on the country, I’d say.
No. And if you don’t have real grey hair and a real walking impediment and the judge finds out, you’ll only make it worse for yourself.
