Except they didn’t steal designs and I’m pretty sure art direction can’t be protected. Even if it could, it would be morally questionable at best. The whole lawsuit also isn’t about that but about some really fringe patents on Nintendo’s part. Patents that Nintendo certainly didn’t come up with, shouldn’t have and last but not least threaten smaller studios in the game industry. Since Pocketpal teamed up with Sony, I don’t consider them indie anymore but it’s true that they have to win this lawsuit for indie devs regardless. If Nintendo gets away with this you can say farewell to smaller game studios in Japan.

On one hand that’s catastrophic and an insult to the art world and art history. On the other hand it’s unsurprising. Does anyone expect google to show relevant top results in this day and age?
I can’t think of a way for this to be legal in the EU by any capacity. I really don’t. They’re essentially claiming they own your likeness just by using their app and I really doubt it’s that simple. It’s kind of like asking for your first born in a readme.txt of a github script. Just because you write something ridiculous doesn’t mean it’s legal.
Not “if” but “when”. They have you and million others on the hook and already plan their next step to extract more money from you.

I’m doubtful of their GaaS promise after they already added premium skins to the game via twitch drops last month. Time will tell, but I know the gaming industry a little too well to just take their word for it.

The US really is a special case even within just America and really cannot be compared to today’s refugee hotspots like Europe at all. For starters, US culture is very young and mostly made up of invaders and migrants. There is very little native culture still there as it has been assimilated for hundreds of years, mostly by Europeans. On top of that, there have been heavy crackdowns on migrant cultures as well, making it anything but the organically grown culture it often claims to be. And as such I think it is a bad example of how unchecked mass migration can work because it didn’t work for the natives and it didn’t happen for the modern US. It does show that strong migration can lead to great success, though it’s still far less densely populated than Europe even now so a direct comparison is still difficult.

Nobody wants it and if amazon/google/microsoft/facebook would be honest about what it really does, the overwhelming majority would decline it in a heartbeat. But corporations do what corporations do best and consumers take it with a shrug. And I kind of get it. Life is too short to learn about everything and make the most informed choice on everything. Often you just shrug it off and never really use it.
And you’d be surprised how many people forget that and then are surprised when they’re taken advantage of.

You would think they know how to use a browser but in reality they only use apps. TikTok being their preferred search engine speaks volumes.
Luckily you don’t have to believe me because, as I said they essentially take ownership as they have stated here. There are very rare cases where this exception is the case or even possible. I mean this clause doesn’t start with ‘You own your mod, unless…’ for a reason. It starts with pretty much ‘You do not own anything unless…’. Larian are developers, not good samaritans. They’re hoping to get something out of this and given their next game will be even more expensive, I’m sure this little silver mine will come in handy down the line. Just taking a look at the mods that are trending tells you they take ownership of almost everything by default.
Note that Larian essentially takes full ownership of anything you upload on their own mod Loader and that you can still install external mods despite claims from some players that you can’t.
I’ve seen some wild discourse on the Steam forums in recent days so let me remind you: It will take some time for some mods to be updated so stay patient.
You may also run into issues with the update itself even if you never used mods. Larian is aware and recommends a full re-download and installation which of course can be very frustrating. Maybe it’s worth waiting a couple weeks or months before jumping back into the game.
Read through the documentation of their newly released modding toolkit and find out, I guess.
What is the industry as a whole trying to get out of this advertisement craze anyway? In the 80s many people in the developed world earned more than twice of what they needed for living. They had lots of cash to just shop around. Now most people barely earn enough to get by and we’re bombarded with easily a hundred times more ads or more. Sorry, but I can’t afford your millionth AI powered NFT sneakers subsciption model no matter how many ads you throw at me. I just cant’t.
